Kenya has gone a full circle since the promulgation of the Constitution of Kenya in 2010. The law recognizes the rights and fundamental freedoms of the people of Kenya as enshrined in the Constitution through the Bill of Rights, and the other International instruments, in which Kenya is part of. The book looks at the Constitution of Kenya as it were, and what the state considers a breach of the security laws, and whether or not the security laws that were enacted in 2016 go against the tenets of democracy and good governance. It must be noted that the Bill of Rights is both universal and also inherent to everyone.Our Constitution vests sovereign power on the people in which it derives its authority from. Any law that is inconsistent with the Constitution is null and void. The book explores the right to press freedom as a Constitutional right and which is what is envisaged in the constitution of Kenya 2010. It is vividly given that such a right should not be arbitrary derogated by the authority or those in power in the name of preserving state security.
